11 June 2014 South Africa’s labour law is on par with many developed countries, according to a new report comparing labour legislation governing redundancies and restructuring in 23 countries around the world. The report, “A Global Employment Guide to Redundancies and Reductions in Force”, was compiled by global law firm DLA Piper, with a chapter on South Africa contributed by local law firm Cliffe Dekker Hofmeyr, and was released last week. Its findings stand in contrast to those of a number of international reports, including the World Economic Forum’s Global Competitiveness Index, which criticise South Africa’s labour law for being rigid and restrictive. Aadil Patel, director and national head of the employment practice at Cliffe Dekker Hofmeyr, said their research showed that South Africa’s employment legislation “is actually on par with many first world counties. The company we keep in terms of our labour legislation regime includes Australia, Singapore, France, the Netherlands, Hong Kong and the United Kingdom.” South Africa received an A-rating for its redundancy and restructuring legislation in the DLA Piper report. According to Patel, an A-rating indicates that legislation is balanced, providing protection and legal recourse for both employers and employees. “An A-rating in this guide means that the country is considered to have procedures to be followed in the redundancy and restructuring process, but it was possible to make redundancies within a reasonable period of time and without incurring liability if the procedures were followed. However, if the pitfalls were not avoided, the cost implications could be fairly significant,” Patel explained. Countries sharing an A-rating with South Africa in the report are Australia, Austria, Belgium, France, Hong Kong, the Netherlands, Norway, Poland, Romania, Russian, Singapore, Spain, Thailand, United Arab Emirates and the United Kingdom. “What this A rating essentially means is that South Africa’s employment legislation compares favourably to other first world countries and offers a similar legal employment framework for multinationals operating in Europe, Asia and the Middle East,” Patel said. The report assigns a G-rating to countries where the redundancy process is relatively straightforward and easy to get right, being quick to implement and with no restrictions or limited requirements which are easy to satisfy. Countries rated G included Mexico and the United States. An R-rating is given to countries where there are significant risks and the processes involved in restructuring and redundancies can be highly regulated, can take a long time and can have significant cost or other implications. Alongside the freshly redesigned iPhone 5, Apple formally launched the newest version of its mobile operating system this morning. iOS 6 will ship pre-installed on the iPhone 5 starting September 21, but existing customers can download it from Apple two days earlier. Scott Forstall took to the stage at the Moscone Center and outlined some of the new features of iOS 6, most of which we already saw at the WWDC in June. Among the most prominent enhancements are PassBook, upgrades to Siri, Facebook integration and a radical overhaul of the native Maps application. Since the iPhone launched in 2007, the device has used Google Maps for navigation and directions. Starting next week, iOS users will say goodbye to the Google experience in favor of Apple’s own solution, which features Siri integration, turn-by-turn GPS and 3D flyover maps. Transit directions are conspicuously absent, which opens up a huge new opportunity for third party transit app developers.Maps isn’t the only Google-made app getting the boot from iOS. Also missing will be the preinstalled YouTube app, which Google released its own version of earlier this week. Passbook will be a very interesting feature to watch. Long-swirling rumors of an NFC chip in the iPhone didn’t come to fruition this morning, but it’s inevitable that Apple will integrate the technology. When that happens, Apple’s new ticketing, gift card and coupon management app is ripe to become a full-blown mobile wallet. Siri is also getting a big update. The voice control feature first debuted on the iPhone 4S will pull from more data sources and be a little more polished. New features include looking up movie times and sports scores, finding restaurants, launching apps and making social updates. Siri’s integration with Maps in particular is bound to make the iPhone 5 the ultimate driving assistant. Just as iOS 5 came with deep Twitter integration, the new version will allow users to connect their Facebook accounts for easy sharing from a variety of apps. This feature has been much anticipated. With it, the world’s biggest social network is baked right into one of the most widely-used mobile operating systems. Other new features in iOS 6 include shared photo streams, FaceTime over 3G, cloud-synced browser tabs and cross-device syncing of iMessages. These are just the highlights. iOS 6 will ship with over 200 new features. zoom Dutch feeder owner and operator JR Shipping Group has sealed a financing deal with a London-based credit investment fund intended to refinance eleven container feeders.The British financier, which remained unnamed, has taken over more than EUR 126 million (USD 151 million) of debt from German HSH Nordbank for the company’s JR Fleet Fund CV, a shipping fund which had financed the company’s eleven container feeders.On December 5, 2017, the bank’s Executive Board gave its approval and the transaction was closed on December 15, the short sea specialist informed.JR Fleet Fund CV is the result of the previous restructuring deal from 2012 made with HSH Nordbank, the shipping company and its CV-partners. However, the deal was dependent upon the market recovery which did not happen. What is more, in 2016, the container feeder market even experienced its fourth dip.“Although for a short time now, the market has been improving, JR Fleet Fund CV has not yet sufficiently benefitted from it,” the company said.Back in 2015, the company saw the need to refinance the fund and it has been in talks with HSH Nordbank on potential options in order to make it a reality. In September 2017, the bank said it wanted to terminate its involvement in the eleven vessels, and JR Shipping then turned to an investment fund in London.
